I was talking to a girl at dinner tonight. This girl works at a bar near my school. The other day, she was at work, talking with her friends. Behind her, the guy who owns the place said something along the lines of "hey chubby, why aren't you working?" (I don't remember exactly what he said, but it definitely involved "chubby"). When she got mad at him, and told him about it, he shouted to everyone around that he apologized to her, that he had to constantly apologize to her.

Soon after, she found herself magically off the schedule for next week, and presumably forever.


This is not cool. However, she follows this story up by saying that she's definitely going to get a lawyer now.

I know, the dude is definitely an asshole. I'm not going to say whether she's right or wrong, but it was such a foreign response to me; I would have quit, chalked it up to another asshole, and gotten on with things.

Is her response common? Warranted? Legal (i.e. did the dude break any laws? did he have to? what could she sue for?

I agree the joke is nothing to get worked up over but a workplace in which you lose your job unless you take everything that is said to you with nothing but a sweet smile is pretty lame.

I mean, if she never called him on it he wouldve said worse and worse things.

How rich is she, how qualified? jobs don't grow on trees, and sacking her without warning probably means she wont make rent unless she gets a new job pretty damn quickly.

so the rent is covered by student loans for now. How qualified is she? She's been a waitress at at least 3 places I can name, does that make her qualified? I don't really know what qualified is for a waitress.

I was just trying to work out how broke she is and how hard it would be for her to find another job. I dunno what qualified is for a waitress either, what I meant was, what other jobs can she do.

If she's still in school, presumably she only waitresses for part time work to keep her loan down and will pick up a higher income job when she graduates.

I guess my view is that since her job isnt the only thing keeping her off the streets, she's probably overreacting with the lawyer aspect. If she was a single mom trying to make ends meet and the guy fired her like that, that would be a little different.

I mean, presumably, the guy was just joking. If she can't take a joke here and there, she doesn't really have any place in the work force.

With the liberal justice system in America what it is, she probably will be able to extort some kind of payment out of this guy. It is really unfortunate the way America has become so politically correct that such a simple thing could shut down this business and potentially damage the local economy.

I hope that she gets nothing for embarassing her manager publicly this way -- nothing is what she deserves.

In some ways I agree with you, in some ways I don't. I think the issue is that I don't know what the situation is. If he had been trying to get her attention and failing, saying "Hey! Chubby!" might have been the verbal equivalent of "Wake up, I'm talking to you!" In that case, this is a totally unwarranted lawsuit. On the other hand, if this was a continuing barrage of insults that had lasted her entire employment history ("hey chubby", "hey fatso", "hey stupid", etc etc etc) I'd say she's got a legitimate case.

Unfortunately, in the throes of "let's see how much money I can make off this", the truth tends to get lost.

When an employer changes the conditions of your job (responsibilities/hours/whatever) in order to cause you to quit, it is called constructive dimissal...

That being said, waitresses probably don't tend to win a lot of labour disputes, because the money is too meagre for anyone to really care about. That being said, I'm talking out of my ass.

The really important question is this: Did you get her phone number? I like chubby girls.
